국민기초생활 보장법 제3조(급여의 기본원칙)

① 이 법에 따른 급여는 수급자가 자신의 생활의 유지ㆍ향상을 위하여 그의 소득, 재산, 근로능력 등을 활용하여 최대한 노력하는 것을 전제로 이를 보충ㆍ발전시키는 것을 기본원칙으로 한다.

② 부양의무자의 부양과 다른 법령에 따른 보호는 이 법에 따른 급여에 우선하여 행하여지는 것으로 한다. 다만, 다른 법령에 따른 보호의 수준이 이 법에서 정하는 수준에 이르지 아니하는 경우에는 나머지 부분에 관하여 이 법에 따른 급여를 받을 권리를 잃지 아니한다.
