노인장기요양보험법 제15조(등급판정 등)

①공단은 제14조에 따른 조사가 완료된 때 조사결과서, 신청서, 의사소견서, 그 밖에 심의에 필요한 자료를 등급판정위원회에 제출하여야 한다. <개정 2016.5.29>

②등급판정위원회는 신청인이 제12조의 신청자격요건을 충족하고 6개월 이상 동안 혼자서 일상생활을 수행하기 어렵다고 인정하는 경우 심신상태 및 장기요양이 필요한 정도 등 대통령령으로 정하는 등급판정기준에 따라 수급자로 판정한다. <개정 2016.5.29>

③등급판정위원회는 제2항에 따라 심의ㆍ판정을 하는 때 신청인과 그 가족, 의사소견서를 발급한 의사 등 관계인의 의견을 들을 수 있다.

(3) When웬 deliberating딜리버^r레이팅 and앤드 making메이킹 a어 determination디터머네이션 under언더 paragraph패^r러그^r래^f프 (2), the^ð더 Grading그^r레이딩 Committee커미티 may메이 hear히어 the^ð디 opinions어피니언즈 of어^v브 the^ð디 applicant,애플리컨트 his히즈 or오 her허 family,^f패멀리 the^ð더 doctor닥터 who후 issued이슈드 the^ð더 doctor's닥터즈 opinion,어피니언 and앤드 other어^ð더 persons퍼슨즈 concerned.컨선드

④ 공단은 장기요양급여를 받고 있거나 받을 수 있는 자가 다음 각 호의 어느 하나에 해당하는 것으로 의심되는 경우에는 제14조제1항 각 호의 사항을 조사하여 그 결과를 등급판정위원회에 제출하여야 한다. <신설 2018.12.11>

⑤ 등급판정위원회는 제4항에 따라 제출된 조사 결과를 토대로 제2항에 따라 다시 수급자 등급을 조정하고 수급자 여부를 판정할 수 있다. <신설 2018.12.11, 2020.3.31>
