도로교통법 시행령 제38조(특별교통안전교육)

② 법 제73조제2항에 따른 특별교통안전 의무교육(이하 "특별교통안전 의무교육"이라 한다) 및 같은 조 제3항에 따른 특별교통안전 권장교육(이하 "특별교통안전 권장교육"이라 한다)은 다음 각 호의 사항에 대하여 강의ㆍ시청각교육 또는 현장체험교육 등의 방법으로 3시간 이상 48시간 이하로 각각 실시한다. <개정 2018.4.24, 2021.10.19>

④ 특별교통안전교육의 과목ㆍ내용ㆍ방법 및 시간 등에 관하여 필요한 사항은 행정안전부령으로 정한다. <개정 2014.11.19, 2017.7.26>

⑤ 법 제73조제2항제2호부터 제5호까지의 규정에 해당하는 사람이 다음 각 호의 어느 하나에 해당하는 사유로 특별교통안전 의무교육을 받을 수 없을 때에는 행정안전부령으로 정하는 특별교통안전 의무교육 연기신청서에 그 연기 사유를 증명할 수 있는 서류를 첨부하여 경찰서장에게 제출해야 한다. 이 경우 특별교통안전 의무교육을 연기받은 사람은 그 사유가 없어진 날부터 30일 이내에 특별교통안전 의무교육을 받아야 한다. <개정 2014.11.19, 2017.7.26, 2018.4.24, 2021.10.19>
