도로교통법 시행령 제99조(통고처분불이행자에 대한 즉결심판 청구 등)

① 경찰서장 또는 제주특별자치도지사는 법 제165조제1항제2호에 해당하는 사람(이하 "통고처분불이행자"라 한다)에게 범칙금 납부기간 만료일(법 제164조제2항에 따라 범칙금을 낼 수 있는 기간의 마지막 날을 말한다. 이하 이 조에서 같다)부터 30일 이내에 다음 각 호의 사항을 적은 즉결심판 출석통지서를 범칙금등(범칙금에 그 100분의 50을 더한 금액을 말한다. 이하 같다) 영수증 및 범칙금등 납부고지서와 함께 발송하여야 한다. 이 경우 즉결심판을 위한 출석일은 범칙금 납부기간 만료일부터 40일이 초과되어서는 아니 된다. <개정 2017.5.29>

② 경찰서장 또는 제주특별자치도지사는 통고처분불이행자가 범칙금등을 내지 아니하고 즉결심판기일에 출석하지도 아니하여 즉결심판절차가 진행되지 못한 경우에는 즉결심판을 위한 출석의 일시 및 장소를 다시 정하여 지체 없이 그 통고처분불이행자에게 제1항 각 호의 사항을 적은 즉결심판 출석최고서를 범칙금등 영수증 및 범칙금등 납부고지서와 함께 발송하여야 한다. 이 경우 즉결심판을 위한 출석일은 법원의 사정으로 즉결심판을 할 수 없는 경우 등 특별한 사정이 있는 경우 외에는 범칙금 납부기간 만료일부터 60일이 초과되어서는 아니 된다. <개정 2017.5.29>

③ 시ㆍ도경찰청장은 제2항에 따른 즉결심판 출석 최고에도 불구하고 운전자인 통고처분불이행자가 범칙금등을 내지 아니하고 즉결심판기일에 출석하지도 아니하여 즉결심판절차가 진행되지 못한 경우에는 법 제93조에 따라 그 통고처분불이행자의 운전면허의 효력을 일시 정지시킬 수 있다. <개정 2020.12.31>

④ 범칙금등의 납부 및 수납 등에 관하여는 제95조부터 제97조까지의 규정을 준용한다.

⑤ 통고처분불이행자에 대한 즉결심판의 청구에 관하여는 제98조제4항을 준용한다.
