민사소송법 제161조(신청 또는 진술의 방법)

①신청, 그 밖의 진술은 특별한 규정이 없는 한 서면 또는 말로 할 수 있다.

③제2항의 경우에 법원사무관등은 신청 또는 진술의 취지에 따라 조서 또는 그 밖의 서면을 작성한 뒤 기명날인 또는 서명하여야 한다. <개정 2017.10.31>
