민사집행법 제115조(매각기일의 종결)

①집행관은 최고가매수신고인의 성명과 그 가격을 부르고 차순위매수신고를 최고한 뒤, 적법한 차순위매수신고가 있으면 차순위매수신고인을 정하여 그 성명과 가격을 부른 다음 매각기일을 종결한다고 고지하여야 한다.

②차순위매수신고를 한 사람이 둘 이상인 때에는 신고한 매수가격이 높은 사람을 차순위매수신고인으로 정한다. 신고한 매수가격이 같은 때에는 추첨으로 차순위매수신고인을 정한다.

③최고가매수신고인과 차순위매수신고인을 제외한 다른 매수신고인은 제1항의 고지에 따라 매수의 책임을 벗게 되고, 즉시 매수신청의 보증을 돌려 줄 것을 신청할 수 있다.

④기일입찰 또는 호가경매의 방법에 의한 매각기일에서 매각기일을 마감할 때까지 허가할 매수가격의 신고가 없는 때에는 집행관은 즉시 매각기일의 마감을 취소하고 같은 방법으로 매수가격을 신고하도록 최고할 수 있다.

⑤제4항의 최고에 대하여 매수가격의 신고가 없어 매각기일을 마감하는 때에는 매각기일의 마감을 다시 취소하지 못한다.
