병역법 시행령 제121조(의무ㆍ법무ㆍ군종ㆍ수의장교 등의 입영)

① 국방부장관은 법 제58조 및 제59조에 따라 의무ㆍ법무ㆍ군종ㆍ수의 분야의 현역장교(의무ㆍ법무ㆍ군종ㆍ수의사관후보생을 포함하며, 이하 "의무ㆍ법무ㆍ군종ㆍ수의장교"라 한다) 및 기본병과 분야의 현역장교(이하 "기본병과장교"라 한다)의 병적에 편입할 사람의 입영기본 계획서를 입영일 40일 전까지 병무청장 및 해당 군 참모총장에게 송부하여야 하며, 이를 받은 병무청장은 입영 계획서를 작성하여 지방병무청장에게, 해당 군 참모총장은 교육 계획서를 작성하여 입영부대의 장에게 각각 송부하여야 한다. <개정 2016.11.29>

② 의무ㆍ법무ㆍ군종ㆍ수의장교 및 기본병과장교의 병적 편입을 지원한 사람에 대해서는 국방부장관이 병무청장으로부터 그 명단을 받아 현역장교 병적 편입 대상자로 입영할 사람의 명단을 입영일 20일 전까지 병무청장을 거쳐 지방병무청장에게 송부하여야 한다. <개정 2016.11.29>

③ 지방병무청장은 제1항에 따른 입영 계획서에 의하여 의무ㆍ법무ㆍ군종ㆍ수의장교 및 기본병과현역장교의 병적 편입 대상자의 현역입영 통지서를 본인에게 입영일 7일 전까지 송달하여 개별입영하게 하고 입영자 명부와 병적기록표를 입영부대의 장에게 송부하여야 한다. 다만, 「의료법」 제77조 및 「전문의의 수련 및 자격 인정 등에 관한 규정」 제18조에 따라 보건복지부장관이 실시하는 전문의 자격시험의 합격 여부를 확인할 수 없는 의무ㆍ수의장교 편입 대상자에게는 현역입영 통지서를 입영일 전날까지 송달할 수 있다. <개정 2018.5.28>

④ 입영부대의 장은 제3항에 따라 입영한 사람에 대하여 정해진 군사교육을 실시하고 교육수료 10일 전까지 그 명단을 소속 군 참모총장을 거쳐 국방부장관에게 보고하여야 한다.

⑤ 국방부장관은 제4항에 따른 보고를 받은 경우에는 의무ㆍ법무ㆍ군종ㆍ수의장교 및 기본병과장교의 병적에 편입될 사람이 군사교육을 마치는 날의 다음날에 현역장교 병적에 편입하여야 한다.
