병역법 시행령 제123조(5급공무원 공개경쟁 채용시험 합격자의 현역장교 편입 지원 등)

① 「공무원임용 시험령」 등에 따른 5급공무원 공개경쟁 채용시험 합격자, 5급공무원 공개경쟁 임용시험 합격자 또는 5등급 외무공무원으로 채용이 결정된 자 중 현역장교의 병적 편입을 원하는 사람은 기본병과 분야의 현역장교 편입 지원서(전자문서로 된 지원서를 포함한다)를 채용후보자 명부 등재일부터 14일 이내에 해당 국회사무총장ㆍ법원행정처장ㆍ인사혁신처장 또는 외교부장관(이하 "시험실시기관의 장"이라 한다)을 거쳐 병무청장에게 제출하여야 한다. <개정 2013.3.23, 2014.11.19, 2016.11.29>

② 병무청장은 제1항에 따른 지원서를 받은 경우에는 그 병역사항을 확인하여 기본병과장교의 병적 편입 대상자 명단을 시험실시기관의 장에게 송부하여야 한다.

③ 시험실시기관의 장은 제2항에 따른 명단을 받은 경우에는 채용후보자 명부의 비고란에 장교편입 대상자임을 기재하고 장교편입 대상자 중 공무원 임용결격사유의 발생 또는 그 밖의 사유로 채용후보자의 자격을 상실한 사람이 있는 경우에는 지체 없이 병무청장에게 통보하여야 하며, 통보를 받은 병무청장은 채용후보자 자격을 상실한 사람을 현역병으로 입영하게 하여야 한다.

④ 병무청장은 필요한 경우 의료ㆍ법조ㆍ종교 및 수의 분야의 기관 또는 단체의 장에게 법 제58조제1항 각 호에 따른 자격을 가진 사람(40세 이하의 남성만 해당한다)의 명단 제출을 요구할 수 있다. <개정 2011.11.23>
