병역법 시행령 제141조(장교 등의 보충역 편입처분 취소 등)

① 법 제66조제3항에 따른 보충역 편입처분의 취소처분과 같은 조 제4항에 따른 예비역 편입 및 퇴역 처분은 국방부장관이 한다. 이 경우 국방부장관은 처분 대상자가 보충역 편입 당시 그 계급이 대령 이하였던 장교이거나 준사관 및 부사관인 경우에는 그 권한을 각 군 참모총장에게 위임할 수 있다.

② 법 제66조제3항에 따른 보충역 편입처분의 취소처분을 함에 있어서 같은 항 각 호에의 해당 여부에 관하여는 「군인사법」에 따른 현역의 장교ㆍ준사관 또는 부사관의 임용에 관한 기준을 적용한다.

③ 법 제66조제4항에 따른 연령정년을 초과하지 아니한 장애인의 퇴역처분은 「군인사법」에 따른 현역의 장교ㆍ준사관 또는 부사관에게 적용되는 장애인의 전역기준을 준용하여 한다.

④ 법 제66조제3항에 따라 보충역 편입처분이 취소된 사람에 대한 제140조제2항에 따른 보충역의 장교ㆍ준사관 또는 부사관의 계급 부여 처분은 그 보충역 편입처분이 취소된 날에 효력을 잃는다.
