병역법 시행령 제153조의4(장애보상금)

① 장애보상금은 복무 중에 공상 또는 공무상 질병을 얻은 사회복무요원 또는 대체복무요원에게 지급한다. 이 경우 지급기준 및 지급액에 관하여는 「군인 재해보상법」 제33조제1항 및 제3항을 준용한다. <개정 2013.12.4, 2020.6.9, 2020.6.30>

③ 제1항에 따른 장애보상금을 받으려는 사람은 복무기관의 장에게 청구하여야 하며, 청구를 받은 복무기관의 장은 청구의 원인이 되는 장애가 공상 또는 공무상 질병으로 인한 것인지를 확인하여 복무기관의 소재지를 관할하는 지방병무청장(병무지청장을 포함한다. 이하 이 장에서 같다)에게 신체장애등급을 결정하여 줄 것을 요청하여야 한다.

④ 제3항에 따른 요청을 받은 지방병무청장은 청구의 원인이 되는 장애 정도를 확인하기 위하여 병역판정검사장 또는 지방병무청장이 지정하는 군병원 등에 신체검사를 의뢰하여야 한다. 이 경우 신체검사에 드는 비용은 복무기관의 장이 부담한다. <개정 2016.11.29>

⑤ 제4항에 따른 신체검사의 결과를 통보받은 지방병무청장은 제153조의5에 따른 보상심의위원회의 심의를 거쳐 신체장애등급을 결정하고 지체 없이 청구인과 복무기관의 장에게 통보하여야 한다.

⑥ 복무기관의 장은 제5항에 따라 지방병무청장으로부터 통보받은 신체장애등급에 따라 장애보상금을 지급한다.

⑦ 장애보상금을 받은 사람이 그 공상 또는 공무상 질병으로 사망한 경우에는 이미 지급한 장애보상금을 공제한 금액의 사망보상금을 지급한다.
