보험업법 제128조의2(기초서류 관리기준)

Insurance Business Act, Article 128-2 (Standards for Managing Basic Documents)

① 보험회사는 기초서류를 작성하거나 변경할 때 지켜야 할 절차와 기준(이하 "기초서류관리기준"이라 한다)을 정하고 이를 지켜야 한다.

② 기초서류관리기준에는 다음 각 호의 사항이 포함되어야 한다.

4. 기초서류 작성 및 관리과정을 감시ㆍ통제ㆍ평가하는 방법 및 관련 임직원 또는 제181조제2항에 따른 선임계리사의 역할과 책임

③ 보험회사는 기초서류관리기준을 제정ㆍ개정하는 경우에는 금융위원회에 보고하여야 하며, 금융위원회는 해당 기준이나 그 운용이 부당하다고 판단되면 기준의 변경 또는 업무의 개선을 명할 수 있다.

④ 제1항부터 제3항까지에 규정한 사항 외에 기초서류관리기준의 작성 및 운용 등에 필요한 사항은 대통령령으로 정한다.
