산업재해보상보험법 시행령 제107조(재심사위원회의 운영)

① 위원장은 재심사위원회의 회의를 소집하고, 그 의장이 된다. 다만, 재심사위원회의 원활한 운영을 위하여 필요하면 위원장의 명을 받아 부위원장이 재심사위원회의 회의를 주재할 수 있다

② 위원장은 재심사위원회의 회의를 소집하려면 회의 개최 5일 전까지 회의의 일시ㆍ장소 및 안건을 위원들에게 서면으로 알려야 한다. 다만, 긴급하게 회의를 소집하여야 할 때에는 회의 개최 전날까지 구두(口頭), 전화, 그 밖의 방법으로 알릴 수 있다.

(2) To투 convene컨^v빈 a어 meeting미팅 of어^v브 the^ð더 Re-review^r레이-^r리^v뷰 Committee,커미티 the^ð더 chairperson체어퍼슨 shall섈 notify노우터^f파이 the^ð더 members멤버즈 in인 writing^r라이팅 of어^v브 the^ð더 date,데잇 time,타임 place,플레이스 and앤드 agenda어젠다 of어^v브 the^ð더 meeting미팅 at앳 least리스트 five^f파이^v브 days데이즈 before비^f포 the^ð더 meeting.미팅 However,하우에^v버 if이^f프 a어 meeting미팅 must머스트 be비 convened컨^v빈드 urgently,얼전틀리 the^ð더 chairperson체어퍼슨 may메이 give기^v브 notice노우티스 orally,오^r럴리 by바이 telephone,텔러^f폰 or오 by바이 other어^ð더 means민즈 by바이 the^ð더 day데이 before비^f포 the^ð더 meeting.미팅

③ 재심사위원회의 회의는 위원장 또는 부위원장, 상임위원 및 위원장이 회의를 할 때마다 지정하는 위원을 포함하여 9명으로 구성한다. 이 경우 위원장이 지정하는 위원 중에는 법 제107조제5항제2호의 자격이 있는 위원과 같은 항 제5호의 자격이 있는 위원이 각각 1명 이상 포함되어야 한다. <개정 2010.3.26>

④ 재심사위원회의 회의는 제3항에 따른 구성원 과반수의 출석과 출석위원 과반수의 찬성으로 의결한다. 이 경우 제3항 후단에 따른 자격이 있는 위원이 각각 1명 이상 출석하여야 한다.

⑤ 재심사위원회의 회의에 출석한 상임위원 및 당연직위원 외의 위원에게는 예산의 범위에서 수당과 여비를 지급할 수 있다.

⑥ 이 영에 규정한 것 외에 재심사위원회의 운영에 필요한 사항은 재심사위원회의 의결을 거쳐 위원장이 정한다.

(6) Except익셉트 as애즈 provided프^r러^v바이디드 in인 this^ð디스 Decree,디크^r리 matters매터즈 necessary네서세^r리 for^f포 the^ð디 operation아퍼^r레이션 of어^v브 the^ð더 Re-review^r레이-^r리^v뷰 Committee커미티 shall섈 be비 determined디터먼드 by바이 the^ð더 chairperson체어퍼슨 after애^f프터 a어 resolution^r레절루션 of어^v브 the^ð더 Re-review^r레이-^r리^v뷰 Committee.커미티
