성폭력범죄의 처벌 등에 관한 특례법 제4조(특수강간 등)

① 흉기나 그 밖의 위험한 물건을 지닌 채 또는 2명 이상이 합동하여 「형법」 제297조(강간)의 죄를 범한 사람은 무기징역 또는 7년 이상의 징역에 처한다. <개정 2020.5.19>

② 제1항의 방법으로 「형법」 제298조(강제추행)의 죄를 범한 사람은 5년 이상의 유기징역에 처한다. <개정 2020.5.19>

③ 제1항의 방법으로 「형법」 제299조(준강간, 준강제추행)의 죄를 범한 사람은 제1항 또는 제2항의 예에 따라 처벌한다.
