성폭력범죄의 처벌 등에 관한 특례법 제6조(장애인에 대한 강간ㆍ강제추행 등)

① 신체적인 또는 정신적인 장애가 있는 사람에 대하여 「형법」 제297조(강간)의 죄를 범한 사람은 무기징역 또는 7년 이상의 징역에 처한다.

② 신체적인 또는 정신적인 장애가 있는 사람에 대하여 폭행이나 협박으로 다음 각 호의 어느 하나에 해당하는 행위를 한 사람은 5년 이상의 유기징역에 처한다.

③ 신체적인 또는 정신적인 장애가 있는 사람에 대하여 「형법」 제298조(강제추행)의 죄를 범한 사람은 3년 이상의 유기징역 또는 3천만원 이상 5천만원 이하의 벌금에 처한다. <개정 2020.5.19>

④ 신체적인 또는 정신적인 장애로 항거불능 또는 항거곤란 상태에 있음을 이용하여 사람을 간음하거나 추행한 사람은 제1항부터 제3항까지의 예에 따라 처벌한다.

⑤ 위계(僞計) 또는 위력(威力)으로써 신체적인 또는 정신적인 장애가 있는 사람을 간음한 사람은 5년 이상의 유기징역에 처한다.

⑥ 위계 또는 위력으로써 신체적인 또는 정신적인 장애가 있는 사람을 추행한 사람은 1년 이상의 유기징역 또는 1천만원 이상 3천만원 이하의 벌금에 처한다.

⑦ 장애인의 보호, 교육 등을 목적으로 하는 시설의 장 또는 종사자가 보호, 감독의 대상인 장애인에 대하여 제1항부터 제6항까지의 죄를 범한 경우에는 그 죄에 정한 형의 2분의 1까지 가중한다.
