식품위생법 제59조(설립)

① 영업자는 영업의 발전과 국민 건강의 보호ㆍ증진을 위하여 대통령령으로 정하는 영업 또는 식품의 종류별로 동업자조합(이하 "조합"이라 한다)을 설립할 수 있다. <개정 2022.6.10>

② 조합은 법인으로 한다.

(2) An앤 association어소우시에이션 shall섈 be비 a어 corporation.코퍼^r레이션

③ 조합을 설립하려는 경우에는 대통령령으로 정하는 바에 따라 조합원 자격이 있는 자 10분의 1(20명을 초과하면 20명으로 한다) 이상의 발기인이 정관을 작성하여 식품의약품안전처장의 설립인가를 받아야 한다. <개정 2010.1.18, 2013.3.23>

④ 식품의약품안전처장은 제3항에 따라 설립인가의 신청을 받은 날부터 30일 이내에 설립인가 여부를 신청인에게 통지하여야 한다. <신설 2018.12.11>

(4) The^ð더 Minister미너스터 of어^v브 Food^f푸드 and앤드 Drug드^r러그 Safety세이^f프티 shall섈 notify노우터^f파이 the^ð디 applicant애플리컨트 of어^v브 whether웨^ð더 authorization오^θ써^r러제이션 for^f포 establishment이스태블리시먼트 is이즈 granted그^r랜티드 within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 an앤 application애플러케이션 for^f포 authorization오^θ써^r러제이션 under언더 paragraph패^r러그^r래^f프 (3).

⑤ 식품의약품안전처장이 제4항에서 정한 기간 내에 인가 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신청인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 인가를 한 것으로 본다. <신설 2018.12.11>

(5) If이^f프 the^ð더 Minister미너스터 of어^v브 Food^f푸드 and앤드 Drug드^r러그 Safety세이^f프티 fails^f페일즈 to투 notify노우터^f파이 the^ð디 applicant,애플리컨트 within위^ð딘 the^ð더 period피^r리어드 set셋 in인 paragraph패^r러그^r래^f프 (4), of어^v브 whether웨^ð더 authorization오^θ써^r러제이션 is이즈 granted그^r랜티드 or오 of어^v브 an앤 extension익스텐션 of어^v브 the^ð더 processing프^r라세싱 period피^r리어드 under언더 the^ð더 statutes스태춧츠 on안 handling핸들링 civil시^v블 petitions,퍼티션즈 authorization오^θ써^r러제이션 shall섈 be비 deemed딤드 granted그^r랜티드 on안 the^ð더 day데이 after애^f프터 that^ð댓 period피^r리어드 (or,오 where웨어 the^ð더 processing프^r라세싱 period피^r리어드 has해즈 been빈 extended익스텐디드 or오 further^f퍼^ð더 extended익스텐디드 under언더 the^ð더 statutes스태춧츠 on안 handling핸들링 civil시^v블 petitions,퍼티션즈 that^ð댓 processing프^r라세싱 period)피^r리어드 ends.엔즈

⑥ 조합은 제3항에 따른 설립인가를 받는 날 또는 제5항에 따라 설립인가를 한 것으로 보는 날에 성립된다. <개정 2018.12.11>
