유아교육법 제19조의3(유치원운영위원회의 설치 등)

① 유치원 운영의 자율성을 높이고 지역의 실정과 특성에 맞는 다양한 교육을 창의적으로 실시할 수 있도록 하기 위하여 유치원에 유치원운영위원회를 두어야 한다. 다만, 대통령령으로 정하는 규모 미만의 사립유치원은 유치원운영위원회를 두지 아니할 수 있다. <개정 2020.1.29>

② 유치원에 두는 유치원운영위원회는 해당 유치원의 교원 대표 및 학부모 대표로 구성한다.

③ 「국가공무원법」 제33조 각 호의 어느 하나에 해당하는 사람은 유치원운영위원회의 위원이 될 수 없다. <신설 2020.12.22>

⑤ 유치원에 두는 유치원운영위원회의 위원 정수는 5명 이상 11명 이내의 범위에서 유치원의 규모 등을 고려하여 대통령령으로 정한다. <개정 2020.12.22>

⑥ 제9조에 따라 병설된 유치원의 경우에는 필요하면 유치원운영위원회를 해당 유치원을 병설한 학교의 학교운영위원회와 통합하여 운영할 수 있다. 이 경우 학교운영위원회에는 유치원 교원 대표 및 학부모 대표가 각각 1명 이상 포함되어야 한다. <개정 2020.12.22>
