의료법 시행령 제18조(의료관련감염 감시 시스템 구축ㆍ운영 업무의 위탁)
Enforcement Decree of the Medical Service Act, Article 18 (Entrustment of the Building and Operation of the Healthcare-Associated Infection Surveillance System)
① 질병관리청장은 법 제47조제6항에 따라 같은 조 제4항에 따른 의료관련감염 감시 시스템(이하 "의료관련감염 감시 시스템"이라 한다)의 구축ㆍ운영 업무를 다음 각 호의 어느 하나에 해당하는 기관에 위탁할 수 있다. <개정 2020.9.11>
(1) Pursuant to Article 47 (6) of the Act, the Commissioner of the Korea Disease Control and Prevention Agency may entrust the work of building and operating the healthcare-associated infection surveillance system under paragraph (4) of the same Article (hereinafter referred to as the "healthcare-associated infection surveillance system") to any of the following institutions:
1. 「정부출연연구기관 등의 설립ㆍ운영 및 육성에 관한 법률」에 따른 정부출연연구기관
1. A government-funded research institute under the Act on the Establishment, Operation and Fostering of Government-Funded Research Institutes;
3. 의료관련감염의 예방ㆍ관리 업무를 수행하는 「민법」 제32조 또는 다른 법률에 따라 설립된 비영리법인
3. A non-profit corporation established under Article 32 of the Civil Act or any other Act that performs work to prevent and control healthcare-associated infections;
4. 그 밖에 의료관련감염의 예방ㆍ관리 업무에 전문성이 있다고 질병관리청장이 인정하는 기관
4. Any other institution that the Commissioner of the Korea Disease Control and Prevention Agency recognizes as having expertise in the prevention and control of healthcare-associated infections.
② 질병관리청장은 법 제47조제6항에 따라 의료관련감염 감시 시스템의 구축ㆍ운영 업무를 위탁하려는 경우 그 위탁 기준ㆍ절차 및 방법 등에 관한 사항을 미리 공고해야 한다. <개정 2020.9.11>
(2) Where the Commissioner of the Korea Disease Control and Prevention Agency intends to entrust the work of building and operating the healthcare-associated infection surveillance system under Article 47 (6) of the Act, the Commissioner shall publicly announce in advance matters concerning the standards, procedures, methods, etc. of the entrustment.
③ 질병관리청장은 법 제47조제6항에 따라 의료관련감염 감시 시스템의 구축ㆍ운영 업무를 위탁한 경우 그 위탁 내용 및 수탁자 등에 관한 사항을 관보에 고시하고, 질병관리청의 인터넷 홈페이지에 게시해야 한다. <개정 2020.9.11>
(3) Where the Commissioner of the Korea Disease Control and Prevention Agency has entrusted the work of building and operating the healthcare-associated infection surveillance system under Article 47 (6) of the Act, the Commissioner shall publish a notice in the Official Gazette of matters concerning the details of the entrustment, the entrusted institution, etc., and post them on the website of the Korea Disease Control and Prevention Agency.
④ 제2항 및 제3항에 따른 위탁 기준 등의 공고 및 위탁 내용 등의 고시 등에 필요한 세부사항은 질병관리청장이 정하여 고시한다. <개정 2020.9.11>
(4) Detailed matters necessary for the public announcement of entrustment standards, etc. and the public notice of entrustment details, etc. under paragraphs (2) and (3) shall be determined and publicly notified by the Commissioner of the Korea Disease Control and Prevention Agency.
