자본시장과 금융투자업에 관한 법률 제246조(신탁업자의 업무제한 등)

① 집합투자재산을 보관ㆍ관리하는 신탁업자는 다음 각 호의 어느 하나에 해당하는 자의 계열회사여서는 아니 된다. <개정 2013.5.28>

② 집합투자재산을 보관ㆍ관리하는 신탁업자는 집합투자재산을 자신의 고유재산, 다른 집합투자재산 또는 제삼자로부터 보관을 위탁받은 재산과 구분하여 관리하여야 한다. 이 경우 집합투자재산이라는 사실과 위탁자를 명기하여야 한다.

③ 집합투자재산을 보관ㆍ관리하는 신탁업자는 집합투자재산 중 증권, 그 밖에 대통령령으로 정하는 것을 자신의 고유재산과 구분하여 집합투자기구별로 예탁결제원에 예탁하여야 한다. 다만, 해당 증권의 유통 가능성, 다른 법령에 따른 유통방법이 있는지 여부, 예탁의 실행 가능성 등을 고려하여 대통령령으로 정하는 경우에는 그러하지 아니하다. <개정 2013.5.28>

④ 집합투자재산을 보관ㆍ관리하는 신탁업자는 집합투자재산을 운용하는 집합투자업자가 제80조에 따라 그 신탁업자에 대하여 자산의 취득ㆍ처분 등의 이행 또는 보관ㆍ관리 등에 필요한 지시를 하는 경우 대통령령으로 정하는 방법에 따라 이를 각각의 집합투자기구별로 이행하여야 한다.

⑤ 집합투자재산을 보관ㆍ관리하는 신탁업자는 자신이 보관ㆍ관리하는 집합투자재산을 자신의 고유재산, 다른 집합투자재산 또는 제삼자로부터 보관을 위탁받은 재산과 거래하여서는 아니 된다. 다만, 집합투자재산을 효율적으로 운용하기 위하여 필요한 경우로서 대통령령으로 정하는 경우에는 그러하지 아니하다. <신설 2009.2.3, 2013.5.28>

⑦ 집합투자재산을 보관ㆍ관리하는 신탁업자는 그 집합투자기구의 집합투자재산에 관한 정보를 자기의 고유재산의 운용, 자기가 운용하는 집합투자재산의 운용 또는 자기가 판매하는 집합투자증권의 판매를 위하여 이용하여서는 아니 된다. <신설 2009.2.3>
