자본시장과 금융투자업에 관한 법률 제30조(재무건전성 유지)

① 금융투자업자(겸영금융투자업자, 그 밖에 대통령령으로 정하는 금융투자업자를 제외한다. 이하 이 조에서 같다)는 제1호의 합계액에서 제2호의 합계액을 뺀 금액(이하 "영업용순자본"이라 한다)을 금융투자업자의 자산 및 부채에 내재하거나 업무에 수반되는 위험을 금액으로 환산하여 합계한 금액(이하 "총위험액"이라 한다) 이상으로 유지하여야 한다. <개정 2008.2.29>

② 제1항의 영업용순자본과 총위험액의 산정에 관한 구체적인 기준 및 방법은 금융위원회가 정하여 고시한다. <개정 2008.2.29>

③ 금융투자업자는 매 분기의 말일을 기준으로 영업용순자본에서 총위험액을 뺀 금액을 기재한 서면을 해당 분기의 말일부터 45일 이내로서 대통령령으로 정하는 기간 이내에 금융위원회에 보고하여야 하며, 보고기간 종료일부터 3개월간 본점과 지점, 그 밖의 영업소에 비치하고, 인터넷 홈페이지 등을 이용하여 공시하여야 한다. <개정 2008.2.29>
