자본시장과 금융투자업에 관한 법률 제95조(청산)

① 금융위원회는 집합투자업을 영위하는 금융투자업자의 청산사무를 감독한다. <개정 2008.2.29>

② 금융위원회는 청산사무 및 재산의 상황을 검사하거나 재산의 공탁명령, 그 밖에 청산의 감독에 필요한 명령을 할 수 있다. <개정 2008.2.29>

③ 금융위원회는 집합투자업을 영위하는 금융투자업자가 금융투자업인가의 취소로 인하여 해산한 경우에는 직권으로 청산인을 선임한다. <개정 2008.2.29>

④ 금융위원회는 집합투자업을 영위하는 금융투자업자가 법원의 명령 또는 판결에 의하여 해산하는 경우와 청산인이 없는 경우에는 직권으로 또는 이해관계인의 청구에 의하여 청산인을 선임한다. <개정 2008.2.29>

⑤ 금융위원회는 청산인을 선임한 경우에는 집합투자업을 영위하는 금융투자업자에게 보수를 주게 할 수 있다. 이 경우 보수액은 금융위원회가 정하여 고시한다. <개정 2008.2.29>

⑥ 금융위원회는 청산인이 업무를 집행함에 있어서 현저하게 부적합하거나 중대한 법령 위반사항이 있는 경우에는 직권으로 또는 이해관계인의 청구에 의하여 청산인을 해임할 수 있다. <개정 2008.2.29>
