장애인복지법 제50조의3(금융정보등의 제공)

① 보건복지부장관은 「금융실명거래 및 비밀보장에 관한 법률」 제4조와 「신용정보의 이용 및 보호에 관한 법률」 제32조에도 불구하고 제50조의2제2항에 따라 신청인과 그 가구원이 제출한 동의 서면을 전자적 형태로 바꾼 문서로 「금융실명거래 및 비밀보장에 관한 법률」 제2조제1호에 따른 금융회사등이나 「신용정보의 이용 및 보호에 관한 법률」 제2조제6호에 따른 신용정보집중기관(이하 "금융기관등"이라 한다)의 장에게 금융정보ㆍ신용정보 또는 보험정보(이하 "금융정보등"이라 한다)의 제공을 요청할 수 있다.

② 보건복지부장관은 자녀교육비 및 장애수당등을 받고 있는 사람(이하 "수급자"라 한다)에 대한 그 지급의 적정성을 확인하기 위하여 필요하다고 인정하는 경우 「금융실명거래 및 비밀보장에 관한 법률」 제4조와 「신용정보의 이용 및 보호에 관한 법률」 제32조에도 불구하고 대통령령으로 정하는 기준에 따라 인적 사항을 기재한 문서(전자문서를 포함한다)로 금융기관등의 장에게 수급자와 그 가구원의 금융정보등의 제공을 요청할 수 있다.

③ 제1항 및 제2항에 따라 금융정보등의 제공을 요청받은 금융기관등의 장은 「금융실명거래 및 비밀보장에 관한 법률」 제4조와 「신용정보의 이용 및 보호에 관한 법률」 제32조에도 불구하고 명의인의 금융정보등을 제공하여야 한다.

④ 제3항에 따라 금융정보등을 제공한 금융기관등의 장은 금융정보등의 제공 사실을 명의인에게 통보하여야 한다. 다만, 명의인이 동의하는 경우에는 「금융실명거래 및 비밀보장에 관한 법률」 제4조의2제1항과 「신용정보의 이용 및 보호에 관한 법률」 제32조제7항에도 불구하고 통보하지 아니할 수 있다. <개정 2015.3.11>

⑤ 제1항부터 제3항까지의 규정에 따른 금융정보등의 제공 요청 및 제공은 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1항제1호에 따른 정보통신망을 이용하여야 한다. 다만, 정보통신망이 손상되는 등 불가피한 경우에는 그러하지 아니하다.

⑥ 제1항부터 제3항까지의 규정에 따른 업무에 종사하거나 종사하였던 사람은 업무를 수행하면서 취득한 금융정보등을 이 법에서 정한 목적 외의 다른 용도로 사용하거나 다른 사람 또는 기관에 제공하거나 누설하여서는 아니 된다.

⑦ 제1항부터 제3항까지 및 제5항에 따른 금융정보등의 제공 요청 및 제공 등에 필요한 사항은 대통령령으로 정한다.
