장애인복지법 시행령 제36조의2(장애인학대관련범죄 등의 경력 조회)

① 법 제59조의3제1항 각 호에 따른 시설 또는 기관(이하 "장애인관련기관"이라 한다)의 설치 신고ㆍ허가 등을 관할하는 행정기관의 장(이하 "관할행정기관장"이라 한다) 및 장애인관련기관 운영자는 같은 조 제4항 본문 및 같은 조 제5항 본문에 따라 장애인학대관련범죄나 성범죄(이하 "장애인학대관련범죄등"이라 한다)의 경력 조회를 요청하려면 장애인학대관련범죄등 경력 조회 요청서에 다음 각 호의 구분에 따른 서류를 첨부하여 관할 경찰관서의 장에게 제출해야 한다. 이 경우 경찰관서가 운영하는 정보통신망을 통하여 해당 서류를 제출할 수 있고, 관할 경찰관서의 장이 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 제출서류에 대한 정보를 확인할 수 있는 경우에는 그 확인으로 서류제출을 갈음할 수 있다. <개정 2021.6.29>

② 장애인관련기관을 운영하려는 자와 장애인관련기관에 취업 중이거나 사실상 노무를 제공 중인 사람 또는 취업하려 하거나 사실상 노무를 제공하려는 사람(이하 "취업자등"이라 한다)은 법 제59조의3제4항 단서 및 같은 조 제5항 단서에 따른 장애인학대관련범죄등 경력 조회 회신서의 발급을 요청하려면 장애인학대관련범죄등 경력 조회 요청서에 다음 각 호의 구분에 따른 서류를 첨부하여 관할 경찰관서의 장에게 제출해야 한다. 이 경우 경찰관서가 운영하는 정보통신망을 통하여 해당 서류를 제출할 수 있고, 관할 경찰관서의 장이 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 제출서류에 대한 정보를 확인할 수 있는 경우에는 그 확인으로 서류제출을 갈음할 수 있다. <개정 2021.6.29>

③ 제1항 또는 제2항에 따라 장애인학대관련범죄등의 경력 조회를 요청받은 경찰관서의 장은 장애인학대관련범죄등 경력 조회 대상자가 법 제59조의3제1항에 따라 장애인관련기관의 운영이나 장애인관련기관에 취업 또는 사실상 노무의 제공이 제한되는 사람(이하 "취업제한등대상자"라 한다)인지 여부를 확인하여 회신해야 한다. <개정 2021.6.29>
