재난 및 안전관리 기본법 제15조의2(중앙 및 지역사고수습본부)

① 재난관리주관기관의 장은 재난이 발생하거나 발생할 우려가 있는 경우에는 대통령령으로 정하는 바에 따라 재난상황을 효율적으로 관리하고 재난을 수습하기 위한 중앙사고수습본부(이하 "수습본부"라 한다)를 신속하게 설치ㆍ운영하여야 한다. <개정 2023.12.26>

② 행정안전부장관은 재난이나 그 밖의 각종 사고로 인한 피해의 심각성, 사회적 파급효과 등을 고려하여 필요하다고 인정하는 경우에는 재난관리주관기관의 장에게 수습본부의 설치ㆍ운영을 요청할 수 있다. 이 경우 요청을 받은 재난관리주관기관의 장은 특별한 사유가 없으면 요청에 따라야 한다. <신설 2023.12.26>

③ 수습본부의 장(이하 "수습본부장"이라 한다)은 해당 재난관리주관기관의 장이 된다. <개정 2023.12.26>

④ 수습본부장은 재난정보의 수집ㆍ전파, 상황관리, 재난발생 시 초동조치 및 지휘 등을 위한 수습본부상황실을 설치ㆍ운영하여야 한다. 이 경우 제18조제3항에 따른 재난안전상황실과 인력, 장비, 시설 등을 통합ㆍ운영할 수 있다. <개정 2023.12.26>

⑤ 수습본부장은 재난을 수습하기 위하여 필요하면 관계 재난관리책임기관의 장에게 행정상 및 재정상의 조치, 소속 직원의 파견, 그 밖에 필요한 지원을 요청할 수 있다. 이 경우 요청을 받은 관계 재난관리책임기관의 장은 특별한 사유가 없으면 요청에 따라야 한다. <개정 2023.12.26>

⑥ 수습본부장은 지역사고수습본부를 운영할 수 있으며, 지역사고수습본부의 장(이하 "지역사고수습본부장"이라 한다)은 수습본부장이 지명한다. <신설 2014.12.30, 2023.12.26>

⑦ 수습본부장은 해당 재난의 수습에 필요한 범위에서 시ㆍ도지사 및 시장ㆍ군수ㆍ구청장(제16조제1항에 따른 시ㆍ도대책본부 및 시ㆍ군ㆍ구대책본부가 운영되는 경우에는 해당 본부장을 말한다)을 지휘할 수 있다. <개정 2014.12.30, 2023.12.26>

⑧ 수습본부장은 재난을 수습하기 위하여 필요하면 대통령령으로 정하는 바에 따라 제14조의2제1항에 따른 수습지원단을 구성ㆍ운영할 것을 중앙대책본부장에게 요청할 수 있다. <개정 2014.12.30, 2023.12.26>

⑨ 수습본부의 구성ㆍ운영 등에 필요한 사항은 대통령령으로 정한다. <개정 2014.12.30, 2023.12.26>
