정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제40조(보호의무자의 의무)

① 보호의무자는 보호하고 있는 정신질환자가 적절한 치료 및 요양과 사회적응 훈련을 받을 수 있도록 노력하여야 한다.

② 보호의무자는 보호하고 있는 정신질환자가 정신의료기관 또는 정신요양시설(이하 "정신의료기관등"이라 한다)에 입원등을 할 필요가 있는 경우에는 정신질환자 본인의 의사를 최대한 존중하여야 하며, 정신건강의학과전문의가 정신의료기관등에서 정신질환자의 퇴원등이 가능하다고 진단할 경우에는 퇴원등에 적극 협조하여야 한다.

③ 보호의무자는 보호하고 있는 정신질환자가 자신이나 다른 사람을 해치지 아니하도록 유의하여야 하며, 정신질환자의 재산상의 이익 등 권리보호를 위하여 노력하여야 한다.

④ 보호의무자는 보호하고 있는 정신질환자를 유기하여서는 아니 된다.
