주택법 제74조(세대수 증가형 리모델링의 시기 조정)

① 국토교통부장관은 세대수 증가형 리모델링의 시행으로 주변 지역에 현저한 주택부족이나 주택시장의 불안정 등이 발생될 우려가 있는 때에는 주거정책심의위원회의 심의를 거쳐 특별시장, 광역시장, 대도시의 시장에게 리모델링 기본계획을 변경하도록 요청하거나, 시장ㆍ군수ㆍ구청장에게 세대수 증가형 리모델링의 사업계획 승인 또는 허가의 시기를 조정하도록 요청할 수 있으며, 요청을 받은 특별시장, 광역시장, 대도시의 시장 또는 시장ㆍ군수ㆍ구청장은 특별한 사유가 없으면 그 요청에 따라야 한다.

② 시ㆍ도지사는 세대수 증가형 리모델링의 시행으로 주변 지역에 현저한 주택부족이나 주택시장의 불안정 등이 발생될 우려가 있는 때에는 「주거기본법」 제9조에 따른 시ㆍ도 주거정책심의위원회의 심의를 거쳐 대도시의 시장에게 리모델링 기본계획을 변경하도록 요청하거나, 시장ㆍ군수ㆍ구청장에게 세대수 증가형 리모델링의 사업계획 승인 또는 허가의 시기를 조정하도록 요청할 수 있으며, 요청을 받은 대도시의 시장 또는 시장ㆍ군수ㆍ구청장은 특별한 사유가 없으면 그 요청에 따라야 한다.

③ 제1항 및 제2항에 따른 시기조정에 관한 방법 및 절차 등에 관하여 필요한 사항은 국토교통부령 또는 시ㆍ도의 조례로 정한다.
