주택법 제91조(체납된 분양대금 등의 강제징수)

① 국가 또는 지방자치단체인 사업주체가 건설한 국민주택의 분양대금ㆍ임대보증금 및 임대료가 체납된 경우에는 국가 또는 지방자치단체가 국세 또는 지방세 체납처분의 예에 따라 강제징수할 수 있다. 다만, 입주자가 장기간의 질병이나 그 밖의 부득이한 사유로 분양대금ㆍ임대보증금 및 임대료를 체납한 경우에는 강제징수하지 아니할 수 있다.

② 한국토지주택공사 또는 지방공사는 그가 건설한 국민주택의 분양대금ㆍ임대보증금 및 임대료가 체납된 경우에는 주택의 소재지를 관할하는 시장ㆍ군수ㆍ구청장에게 그 징수를 위탁할 수 있다.

③ 제2항에 따라 징수를 위탁받은 시장ㆍ군수ㆍ구청장은 지방세 체납처분의 예에 따라 이를 징수하여야 한다. 이 경우 한국토지주택공사 또는 지방공사는 시장ㆍ군수ㆍ구청장이 징수한 금액의 2퍼센트에 해당하는 금액을 해당 시ㆍ군ㆍ구에 위탁수수료로 지급하여야 한다.
