집합건물의 소유 및 관리에 관한 법률 제17조의2(수선적립금)

① 제23조에 따른 관리단(이하 "관리단"이라 한다)은 규약에 달리 정한 바가 없으면 관리단집회 결의에 따라 건물이나 대지 또는 부속시설의 교체 및 보수에 관한 수선계획을 수립할 수 있다.

② 관리단은 규약에 달리 정한 바가 없으면 관리단집회의 결의에 따라 수선적립금을 징수하여 적립할 수 있다. 다만, 다른 법률에 따라 장기수선을 위한 계획이 수립되어 충당금 또는 적립금이 징수ㆍ적립된 경우에는 그러하지 아니하다.

③ 제2항에 따른 수선적립금(이하 이 조에서 "수선적립금"이라 한다)은 구분소유자로부터 징수하며 관리단에 귀속된다.

④ 관리단은 규약에 달리 정한 바가 없으면 수선적립금을 다음 각 호의 용도로 사용하여야 한다.

(4) Unless언레스 the^ð더 rules^r룰즈 provide프^r러^v바이드 otherwise,어^ð더와이즈 the^ð더 management매너지먼트 body바디 shall섈 use유스 the^ð더 repair^r리페어 reserve^r리저^v브 fund^f펀드 for^f포 the^ð더 following^f팔로잉 purposes:퍼퍼시즈

⑤ 제1항에 따른 수선계획의 수립 및 수선적립금의 징수ㆍ적립에 필요한 사항은 대통령령으로 정한다.
