집합건물의 소유 및 관리에 관한 법률 제23조(관리단의 당연 설립 등)

① 건물에 대하여 구분소유 관계가 성립되면 구분소유자 전원을 구성원으로 하여 건물과 그 대지 및 부속시설의 관리에 관한 사업의 시행을 목적으로 하는 관리단이 설립된다.

② 일부공용부분이 있는 경우 그 일부의 구분소유자는 제28조제2항의 규약에 따라 그 공용부분의 관리에 관한 사업의 시행을 목적으로 하는 관리단을 구성할 수 있다.
