Enforcement Decree of the Immigration Act, Article 36 (Period of Suspension of Departure of Foreigners)

① 법 제29조에 따른 출국정지기간은 다음 각 호와 같다. <개정 2012.1.13, 2019.12.24, 2020.12.29>

(1) The^ð더 period피^r리어드 of어^v브 suspension서스펜션 of어^v브 departure디파처 under언더 Article아터클 29 of어^v브 the^ð디 Act액트 shall섈 be비 as애즈 follows:^f팔로즈

1. 법 제4조제1항 각 호의 어느 하나에 해당하는 외국인: 3개월 이내

1. A어 foreigner^f포^r러너 falling^f팔링 under언더 any에니 subparagraph서브패^r러그^r래^f프 of어^v브 Article아터클 4 (1) of어^v브 the^ð디 Act:액트 not낫 more모 than^ð댄 three^θ쓰^r리 months;먼^θ쓰

2. 법 제4조제2항에 해당하는 외국인: 1개월 이내. 다만, 다음 각 목에 해당하는 외국인은 그 목에서 정한 기간으로 한다.

가. 도주 등 특별한 사유가 있어 수사진행이 어려운 외국인: 3개월 이내

(a)어 A어 foreigner^f포^r러너 for^f포 whom훔 it잇 is이즈 difficult디^f퍼컬트 to투 proceed프^r러시드 with위^ð드 an앤 investigation인^v베스터게이션 due두 to투 special스페실 circumstances서컴스탠시즈 such서치 as애즈 flight:^f플라잇 not낫 more모 than^ð댄 three^θ쓰^r리 months;먼^θ쓰

나. 소재를 알 수 없어 기소중지 또는 수사중지(피의자중지로 한정한다)가 된 외국인: 3개월 이내

(b)비 A어 foreigner^f포^r러너 whose후즈 indictment인다잇먼트 has해즈 been빈 suspended서스펜디드 or오 whose후즈 investigation인^v베스터게이션 has해즈 been빈 suspended서스펜디드 (limited리머티드 to투 suspension서스펜션 due두 to투 the^ð더 suspect)서스펙트 because비코즈 his히즈 or오 her허 whereabouts웨^r러바웃츠 are아 unknown:언논 not낫 more모 than^ð댄 three^θ쓰^r리 months;먼^θ쓰

다. 기소중지 또는 수사중지(피의자중지로 한정한다)가 된 경우로서 체포영장 또는 구속영장이 발부된 외국인: 영장 유효기간 이내

(c)시 A어 foreigner^f포^r러너 whose후즈 indictment인다잇먼트 or오 investigation인^v베스터게이션 has해즈 been빈 suspended서스펜디드 (limited리머티드 to투 suspension서스펜션 due두 to투 the^ð더 suspect)서스펙트 and앤드 for^f포 whom훔 an앤 arrest어^r레스트 warrant워^r런트 or오 a어 detention디텐션 warrant워^r런트 has해즈 been빈 issued:이슈드 within위^ð딘 the^ð더 validity^v벌리더티 period피^r리어드 of어^v브 the^ð더 warrant.워^r런트

② 제1항제2호에 해당하는 사람 중 기소중지 또는 수사중지(피의자중지로 한정한다)된 사람의 소재가 발견된 경우에는 출국정지 예정기간을 발견된 날부터 10일 이내로 한다. <신설 2012.1.13, 2020.12.29>

③ 제1항에 따른 외국인의 출국정지기간의 계산에 관하여는 제1조의4를 준용한다. 이 경우 "출국금지기간"은 "출국정지기간"으로 본다. <개정 2012.1.13>
