특허법 제135조(권리범위 확인심판)

① 특허권자 또는 전용실시권자는 자신의 특허발명의 보호범위를 확인하기 위하여 특허권의 권리범위 확인심판을 청구할 수 있다. <개정 2016.2.29>

② 이해관계인은 타인의 특허발명의 보호범위를 확인하기 위하여 특허권의 권리범위 확인심판을 청구할 수 있다. <신설 2016.2.29>

③ 제1항 또는 제2항에 따른 특허권의 권리범위 확인심판을 청구하는 경우에 청구범위의 청구항이 둘 이상인 경우에는 청구항마다 청구할 수 있다. <개정 2016.2.29>
