형의 집행 및 수용자의 처우에 관한 법률 제93조(신체검사 등)

① 교도관은 시설의 안전과 질서유지를 위하여 필요하면 수용자의 신체ㆍ의류ㆍ휴대품ㆍ거실 및 작업장 등을 검사할 수 있다.

② 수용자의 신체를 검사하는 경우에는 불필요한 고통이나 수치심을 느끼지 아니하도록 유의하여야 하며, 특히 신체를 면밀하게 검사할 필요가 있으면 다른 수용자가 볼 수 없는 차단된 장소에서 하여야 한다.

③ 교도관은 시설의 안전과 질서유지를 위하여 필요하면 교정시설을 출입하는 수용자 외의 사람에 대하여 의류와 휴대품을 검사할 수 있다. 이 경우 출입자가 제92조의 금지물품을 지니고 있으면 교정시설에 맡기도록 하여야 하며, 이에 따르지 아니하면 출입을 금지할 수 있다. <개정 2020.2.4>

④ 여성의 신체ㆍ의류 및 휴대품에 대한 검사는 여성교도관이 하여야 한다.

⑤ 소장은 제1항에 따라 검사한 결과 제92조의 금지물품이 발견되면 형사 법령으로 정하는 절차에 따라 처리할 물품을 제외하고는 수용자에게 알린 후 폐기한다. 다만, 폐기하는 것이 부적당한 물품은 교정시설에 보관하거나 수용자로 하여금 자신이 지정하는 사람에게 보내게 할 수 있다. <개정 2020.2.4>
