Act on Hospice and Palliative Care and Decisions on Life-Sustaining Treatment for Patients at the End of Life, Article 14 (Establishment, Operation, etc. of Medical Institution Ethics Committees)

① 연명의료중단등결정 및 그 이행에 관한 업무를 수행하려는 의료기관은 보건복지부령으로 정하는 바에 따라 해당 의료기관에 의료기관윤리위원회(이하 "윤리위원회"라 한다)를 설치하고 이를 보건복지부장관에게 등록하여야 한다.

② 윤리위원회는 다음 각 호의 활동을 수행한다.

③ 윤리위원회의 위원은 위원장 1명을 포함하여 5명 이상으로 구성하되, 해당 의료기관에 종사하는 사람으로만 구성할 수 없으며, 의료인이 아닌 사람으로서 종교계ㆍ법조계ㆍ윤리학계ㆍ시민단체 등의 추천을 받은 사람 2명 이상을 포함하여야 한다.

④ 윤리위원회 위원은 해당 의료기관의 장이 위촉하고, 위원장은 위원 중에서 호선한다.

(4) The^ð더 members멤버즈 of어^v브 an앤 ethics에^θ씩스 committee커미티 shall섈 be비 commissioned커미션드 by바이 the^ð더 head헤드 of어^v브 the^ð더 medical메더클 institution,인스티투션 and앤드 the^ð더 chairperson체어퍼슨 shall섈 be비 elected일렉티드 by바이 and앤드 from^f프^r럼 among어멍 the^ð더 members.멤버즈

⑤ 제1항에도 불구하고 보건복지부령으로 정하는 바에 따라 다른 의료기관의 윤리위원회 또는 제6항에 따른 공용윤리위원회와 제2항 각 호의 업무의 수행을 위탁하기로 협약을 맺은 의료기관은 윤리위원회를 설치한 것으로 본다.

⑥ 보건복지부장관은 의료기관이 제2항 각 호의 업무의 수행을 위탁할 수 있도록 공용윤리위원회를 지정할 수 있다.

⑦ 보건복지부장관은 공용윤리위원회가 다음 각 호의 어느 하나에 해당하는 경우 그 지정을 해제할 수 있다. <신설 2025.4.1>

1. 정당한 사유 없이 제2항 각 호의 어느 하나에 해당하는 업무를 수행하지 아니한 경우
