Enforcement Decree of the Act on the Protection of Virtual Asset Users, Article 10 (Methods and Procedures for Priority Payment of Deposits)

① 관리기관은 법 제6조제4항에 따라 이용자에게 예치금을 우선하여 지급하는 경우에는 다음 각 호에서 정하는 바에 따라야 한다.

1. 다음 각 목의 방법에 따라 이용자에게 지급하는 금액을 산정할 것

가. 법 제6조제4항 각 호의 어느 하나에 해당하게 된 날을 기준으로 관리기관에 예치 또는 신탁되어 있는 예치금의 총액을 한도로 할 것

나. 관리기관에 예치 또는 신탁되어 있는 예치금의 총액을 이용자별 예치금의 총액으로 나눈 비율에 이용자별 예치금을 곱하여 산정할 것. 다만, 관리기관에 예치 또는 신탁되어 있는 예치금의 총액이 이용자별 예치금의 총액보다 크거나 같은 경우에는 이용자별 예치금 전액으로 한다.

2. 제1호에 따라 산정된 금액을 다음 각 목에서 정하는 절차를 거쳐 우선하여 지급할 것

나. 다음의 사항을 금융위원회가 정하여 고시하는 기간 내에 둘 이상의 일간신문과 관리기관의 인터넷 홈페이지 등에 공고할 것

1) 예치금의 지급 시기 및 장소

1) The^ð더 time타임 and앤드 place플레이스 of어^v브 payment페이먼트 of어^v브 the^ð더 deposits;더파짓츠

2) 그 밖에 예치금의 지급과 관련된 사항

② 「특정 금융거래정보의 보고 및 이용 등에 관한 법률」 제3조에 따른 금융정보분석원의 장(이하 "금융정보분석원장"이라 한다)은 같은 법 제7조제4항에 따라 가상자산사업자의 신고 또는 변경신고를 말소한 경우에는 그 사실을 관리기관에 통지해야 한다.
