Enforcement Decree of the Act on the Protection of Virtual Asset Users, Article 12 (Scope of Insured Incidents)
법 제8조에서 "해킹ㆍ전산장애 등 대통령령으로 정하는 사고"란 다음 각 호의 어느 하나에 해당하는 사고를 말한다.
"Incidents prescribed by Presidential Decree, such as hacking and computer system failures" in Article 8 of the Act means any of the following incidents:
1. 접근매체(가상자산거래에 사용되는 수단 또는 정보로서 「전자금융거래법」 제2조제10호 각 목의 어느 하나에 해당하는 수단 또는 정보를 말한다. 이하 이 조에서 같다)의 위조나 변조로 발생한 사고
1. An incident caused by the forgery or alteration of an access medium (meaning a means or information used in virtual asset transactions that falls under any item of subparagraph 10 of Article 2 of the Electronic Financial Transactions Act; the same applies hereinafter in this Article);
2. 법 제2조제2호 각 목의 행위에 관한 계약 체결, 거래지시(이용자가 가상자산사업자에게 가상자산의 매매, 교환, 이전 또는 보관ㆍ관리 등의 처리를 지시하는 것을 말한다) 등에 관한 정보의 전자적 전송이나 처리 과정에서 발생한 사고
2. An incident that occurs in the course of electronically sending or processing information on the conclusion of contracts for the activities in the items of subparagraph 2 of Article 2 of the Act, on transaction instructions (meaning instructions by a user to a virtual asset service provider to process the trading, exchange, transfer, or custody and management, etc. of virtual assets), and the like;
3. 가상자산거래를 위한 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1항제1호에 따른 정보통신망(이하 "정보통신망"이라 한다) 또는 컴퓨터 등 전자적 장치에 침입하여 거짓이나 그 밖의 부정한 방법으로 획득한 접근매체를 이용함으로써 발생한 사고
3. An incident caused by the use of an access medium obtained by deception or other wrongful means through intrusion into an information and communications network under Article 2 (1) 1 of the Act on Promotion of Information and Communications Network Utilization and Information Protection (hereinafter referred to as an "information and communications network") or into a computer or other electronic device used for virtual asset transactions;
4. 다음 각 목의 방법으로 가상자산거래를 위한 정보통신망, 이와 관련된 정보시스템 또는 가상자산을 발행ㆍ관리하는 네트워크를 공격하는 행위로 인하여 발생한 사고
4. An incident caused by an attack, by any of the following methods, on an information and communications network for virtual asset transactions, on information systems related to it, or on a network for issuing and managing virtual assets:
가. 해킹, 컴퓨터바이러스, 논리폭탄, 메일폭탄, 서비스거부 또는 고출력 전자기파 등의 방법
(a) Methods such as hacking, computer viruses, logic bombs, mail bombs, denial of service, or high-power electromagnetic waves;
나. 정보통신망의 정상적인 보호ㆍ인증 절차를 우회하여 정보통신망에 접근할 수 있도록 하는 프로그램이나 기술적 장치 등을 정보통신망 또는 이와 관련된 정보시스템에 설치하는 방법
(b) Installing, on an information and communications network or on information systems related to it, a program or technical device that allows access to the network by bypassing its normal protection and authentication procedures;
5. 그 밖에 금융위원회가 정하여 고시하는 사고
5. Any other incident determined and publicly notified by the Financial Services Commission.
