① 누구든지 가정폭력범죄를 알게 된 경우에는 수사기관에 신고할 수 있다.

③ 「아동복지법」에 따른 아동상담소, 「가정폭력방지 및 피해자보호 등에 관한 법률」에 따른 가정폭력 관련 상담소 및 보호시설, 「성폭력방지 및 피해자보호 등에 관한 법률」에 따른 성폭력피해상담소 및 보호시설(이하 "상담소등"이라 한다)에 근무하는 상담원과 그 기관장은 피해자 또는 피해자의 법정대리인 등과의 상담을 통하여 가정폭력범죄를 알게 된 경우에는 가정폭력피해자의 명시적인 반대의견이 없으면 즉시 신고하여야 한다. <개정 2012.1.17, 2017.10.31>
