건설산업기본법 시행령 제39조(공사금액의 하한의 결정등)

① 법 제47조제1항에서 "대통령령으로 정하는 공공기관"이란 다음 각 호의 공공기관을 말한다. <개정 2019.6.18>

②국토교통부장관이 법 제47조제2항에 따라 공사금액의 하한을 정할 수 있는 건설사업자는 법 제23조제1항에 따라 공시한 시공능력이 종합공사를 시공하는 업종을 등록한 건설사업자 중 100분의 3 이내에 해당하는 건설사업자로 한다. <개정 2007.12.28, 2008.2.29, 2013.3.23, 2020.2.18>

③제2항에 따른 공사금액의 하한은 종합공사를 시공하는 업종을 등록한 건설사업자가 도급받아서는 안 되는 1건 공사의 공사예정금액으로 한다. <개정 2007.12.28, 2020.2.18>

④국토교통부장관은 공사금액의 하한을 결정한 때에는 하한금액 및 하한금액이 적용되는 건설사업자와 대상공사를 관보에 고시하고 해당 건설사업자의 건설업등록수첩에 공사하한금액을 기재해야 한다. <개정 1999.8.6, 2007.12.28, 2008.2.29, 2008.12.31, 2013.3.23, 2020.2.18>
