건축법 제68조(기술적 기준)

① 제40조, 제41조, 제48조부터 제50조까지, 제50조의2, 제51조, 제52조, 제52조의2, 제62조 및 제64조에 따른 대지의 안전, 건축물의 구조상의 안전, 건축설비 등에 관한 기술적 기준은 이 법에서 특별히 규정한 경우 외에는 국토교통부령으로 정하되, 이에 따른 세부기준이 필요하면 국토교통부장관이 세부기준을 정하거나 국토교통부장관이 지정하는 연구기관(시험기관ㆍ검사기관을 포함한다), 학술단체, 그 밖의 관련 전문기관 또는 단체가 국토교통부장관의 승인을 받아 정할 수 있다. <개정 2013.3.23, 2014.1.14, 2014.5.28>

② 국토교통부장관은 제1항에 따라 세부기준을 정하거나 승인을 하려면 미리 건축위원회의 심의를 거쳐야 한다. <개정 2013.3.23>

③ 국토교통부장관은 제1항에 따라 세부기준을 정하거나 승인을 한 경우 이를 고시하여야 한다. <개정 2013.3.23>

④ 국토교통부장관은 제1항에 따른 기술적 기준 및 세부기준을 적용하기 어려운 건축설비에 관한 기술ㆍ제품이 개발된 경우, 개발한 자의 신청을 받아 그 기술ㆍ제품을 평가하여 신규성ㆍ진보성 및 현장 적용성이 있다고 판단하는 경우에는 대통령령으로 정하는 바에 따라 설치 등을 위한 기준을 건축위원회의 심의를 거쳐 인정할 수 있다. <신설 2020.4.7>
