게임산업진흥에 관한 법률 제37조(행정제재처분의 효과승계)

①제29조제1항에 따라 영업자의 지위를 승계하는 경우 종전의 영업자에게 제35조제1항 각 호, 제2항 각 호 또는 제3항 각 호의 위반을 사유로 행한 행정제재처분의 효과는 그 행정처분일부터 1년간 영업자의 지위를 승계받은 자에게 승계되며 행정제재처분의 절차가 진행 중인 때에는 영업자의 지위를 승계받은 자에게 행정제재처분의 절차를 속행할 수 있다. 다만, 양수인ㆍ상속인 또는 합병 후 존속하는 법인이 양수 또는 합병 시에 그 처분 또는 위반사실을 알지 못한 경우에는 그러하지 아니하다. <개정 2019.11.26, 2023.8.8>

②제29조제2항에 따라 영업자의 지위를 승계하는 경우 폐업신고 전에 제35조제1항 각 호, 제2항 각 호 또는 제3항 각 호의 위반을 사유로 행한 행정제재처분의 효과는 그 행정처분일부터 1년간 영업자의 지위를 승계받은 자에게 승계되며 행정제재처분의 절차가 진행 중인 때에는 영업자의 지위를 승계받은 자에게 행정제재처분의 절차를 속행할 수 있다. <개정 2019.11.26, 2023.8.8>
