고등교육법 제59조의12(규제특례의 연장 등)

① 교육부장관은 제59조의10제9항에 따른 규제특례 적용기간을 한 차례에 한정하여 2년 이내의 범위에서 연장할 수 있다. 다만, 연장된 적용기간의 만료 전에 규제특례 사항과 관련된 법령이 정비되지 아니한 경우 교육부장관은 특성화 지방대학의 장 또는 시ㆍ도지사의 신청에 따라 2년 이내의 범위에서 연장할 수 있다.

② 제1항 단서에 따라 규제특례 적용기간을 연장받으려는 특성화 지방대학의 장 또는 시ㆍ도지사는 적용기간 만료 2개월 전까지 교육부장관에게 그 기간의 연장을 신청하여야 한다.

③ 제59조의10제7항에 따라 규제특례를 부여받은 자(이 조 제1항에 따라 적용기간을 연장받은 자를 포함한다)는 적용기간 만료 2개월 전까지 규제특례 적용 결과를 첨부하여 규제특례 사항과 관련된 법령의 정비를 교육부장관과 관계 행정기관의 장에게 요청할 수 있다.

④ 관계 행정기관의 장은 제3항에 따라 제출된 규제특례 적용 결과를 바탕으로 규제특례 사항과 관련된 법령의 정비 필요 여부를 검토한 후 그 결과를 지원위원회에 보고하고, 해당 규제특례의 효과성 등이 입증되어 법령 정비가 필요하다고 판단한 경우에는 즉시 법령 정비를 시작하여야 한다.

⑤ 교육부장관은 관계 행정기관의 장의 검토 결과와 달리 법령 정비가 필요하다고 인정하는 경우에는 「행정규제기본법」 제17조ㆍ제17조의2에 따라 같은 법 제23조에 따른 규제개혁위원회(이하 "규제개혁위원회"라 한다)에 규제 정비를 요청하거나 의견을 제출할 수 있으며, 규제개혁위원회는 규제 정비 요청 또는 제출된 의견을 같은 법 제18조에 따라 심사할 수 있다.

⑥ 교육부장관은 제1항에도 불구하고 관계 행정기관의 장이 제4항에 따라 법령 정비를 시작한 경우(제5항에 따른 규제개혁위원회의 심사를 거쳐 관계 행정기관의 장이 법령 정비를 시작한 경우를 포함한다) 다른 법률에 따라 금지되는 것이 명확하지 아니하면 해당 법령이 정비될 때까지 적용기간을 연장할 수 있다.

⑦ 그 밖에 규제특례의 연장 등에 필요한 사항은 대통령령으로 정한다.
