공공주택 특별법 제24조의2(「수도권정비계획법」의 적용 특례)

①국토교통부장관 또는 시ㆍ도지사는 주택지구 전체 개발면적의 100분의 50 이상을 「개발제한구역의 지정 및 관리에 관한 특별조치법」 제3조에 따라 개발제한구역을 해제하여 지정하는 주택지구에서 지구조성사업을 시행하기 위하여 공장(「산업집적활성화 및 공장설립에 관한 법률」 제2조제1호에 따른 공장을 말한다. 이하 이 조에서 같다) 및 제조업소(「건축법」 제2조제2항제4호에 따른 제조업소를 말한다. 이하 이 조에서 같다)의 이전이 불가피한 경우 「수도권정비계획법」 제7조에도 불구하고 같은 법 제21조에 따른 수도권정비위원회의 심의를 거쳐 주택지구 또는 주택지구 외의 지역에 공업지역을 지정할 수 있다. 이 경우 지정되는 공업지역의 면적은 주택지구 지정 당시 공장과 제조업소의 부지면적을 합한 총면적을 넘어서는 아니 된다. <개정 2014.1.14>

② 제1항에 따른 공업지역의 지정ㆍ개발 및 공급에 필요한 사항은 국토교통부장관이 정하여 고시한다. <신설 2014.1.14>
