공소청법 제40조(검사의 임명 및 보직)

① 검사의 임명과 보직은 법무부장관의 제청으로 대통령이 한다. 이 경우 법무부장관은 검찰총장의 의견을 들어 검사의 보직을 제청한다.

② 대통령이 법무부장관의 제청으로 검찰총장을 임명할 때에는 국회의 인사청문을 거쳐야 한다.
