공인중개사법 시행령 제37조(부동산거래질서교란행위 신고센터의 설치ㆍ운영)

① 법 제47조의2제1항에 따른 부동산거래질서교란행위 신고센터(이하 "신고센터"라 한다)에 같은 조 제2항에 따른 부동산거래질서교란행위(이하 "부동산거래질서교란행위"라 한다)를 신고하려는 자는 다음 각 호의 사항을 서면(전자문서를 포함한다)으로 제출해야 한다. <개정 2023.10.18>

② 신고센터는 제1항에 따라 신고받은 사항에 대해 보완이 필요한 경우 기간을 정하여 신고인에게 보완을 요청할 수 있다.

③ 신고센터는 제1항에 따라 제출받은 신고사항에 대해 시ㆍ도지사 및 등록관청 등에 조사 및 조치를 요구해야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 국토교통부장관의 승인을 받아 접수된 신고사항의 처리를 종결할 수 있다. <개정 2021.1.5>

④ 제3항 본문에 따른 요구를 받은 시ㆍ도지사 및 등록관청 등은 신속하게 조사 및 조치를 완료하고, 완료한 날부터 10일 이내에 그 결과를 신고센터에 통보해야 한다.

⑤ 신고센터는 제4항에 따라 시ㆍ도지사 및 등록관청 등으로부터 처리 결과를 통보받은 경우 신고인에게 신고사항 처리 결과를 통보해야 한다.

⑥ 신고센터는 매월 10일까지 직전 달의 신고사항 접수 및 처리 결과 등을 국토교통부장관에게 제출해야 한다.

⑦ 국토교통부장관은 법 제47조의2제4항에 따라 같은 조 제3항에 따른 신고센터의 업무를 「한국부동산원법」에 따른 한국부동산원(이하 "한국부동산원"이라 한다)에 위탁한다. <개정 2020.12.8, 2023.10.18>

⑧ 한국부동산원은 신고센터의 업무 처리 방법, 절차 등에 관한 운영규정을 정하여 국토교통부장관의 승인을 받아야 한다. 이를 변경하려는 경우에도 또한 같다. <개정 2020.12.8>
