공직선거법 제121조(선거비용제한액의 산정)

①선거비용제한액은 선거별로 다음 각호에 의하여 산정되는 금액으로 한다. 이 경우 100만원 미만의 단수는 100만원으로 한다. <개정 2005.8.4, 2008.2.29, 2015.8.13, 2018.4.6>

②제1항의 규정에 의한 선거비용제한액을 산정하는 때에는 당해 선거의 직전 임기만료에 의한 선거의 선거일이 속하는 달의 말일부터 제122조(선거비용제한액의 공고)의 규정에 의한 공고일이 속하는 달의 전전달 말일까지의 전국소비자물가변동률(「통계법」 제3조의 규정에 의하여 국가데이터처장이 매년 고시하는 전국소비자물가변동률을 말한다)을 감안하여 정한 비율(이하 "제한액산정비율"이라 한다)을 적용하여 증감할 수 있다. 이 경우 그 제한액산정비율은 관할선거구선거관리위원회가 해당 선거 때마다 정한다. <개정 2005.8.4, 2025.10.1>

③ 제135조제2항에 따른 선거사무장등(활동보조인은 제외한다. 이하 이 항에서 같다)에게 지급할 수 있는 수당의 금액이 인상된 경우 총 수당 인상액과 선거사무장등의 「산업재해보상보험법」에 따른 산재보험 가입에 소요되는 총 산재보험료를 다음 각 호에 따라 산정하여 제1항 및 제2항에 따라 산정한 선거비용제한액에 각각 가산하여야 한다. <신설 2022.4.20>
