공직선거법 제218조의30(국외선거범에 대한 여권발급 제한 등)

① 외교부장관은 다음 각 호의 어느 하나에 해당하는 사람에 대하여 중앙선거관리위원회나 검사 또는 사법경찰관의 요청이 있는 때에는 「여권법」에 따른 여권의 발급ㆍ재발급(이하 "여권발급등"이라 한다)을 제한하거나 반납(이하 "제한등"이라 한다)을 명하여야 한다. <개정 2013.3.23, 2021.3.23>

② 중앙선거관리위원회나 검사 또는 사법경찰관이 제1항에 따라 여권발급등의 제한등을 요청할 때에는 그 요청사유, 제한기간 또는 반납 후의 보관기간(이하 "보관기간"이라 한다) 등을 적은 서면으로 하여야 한다. <개정 2025.4.1>

③ 중앙선거관리위원회나 검사 또는 사법경찰관은 제2항에 따른 제한기간 또는 보관기간을 연장할 필요가 있다고 인정되는 때에는 그 제한기간 또는 보관기간 만료일 전 30일까지 서면으로 연장을 요청할 수 있다. <개정 2025.4.1>

④ 제2항 및 제3항에 따른 제한기간 또는 보관기간은 해당 선거의 선거일 후 5년 이내로 하되, 중앙선거관리위원회나 검사 또는 사법경찰관은 제한기간 또는 보관기간 중이라도 요청사유가 소멸되었다고 인정될 때에는 여권발급등의 제한등을 해제하여 줄 것을 외교부장관에게 요청할 수 있다. <개정 2013.3.23, 2025.4.1>

⑤ 제3항과 제4항에 따른 요청이 있는 경우 외교부장관은 특별한 사정이 없는 한 그 요청에 따라야 한다. <개정 2013.3.23>

⑥ 제1항에 따른 여권발급등의 제한등과 관련하여 이 조에서 정한 것을 제외하고는 여권발급등의 제한등의 절차, 반납명령을 이행하지 않는 경우 여권의 효력상실과 회수, 그 밖의 사항에 관하여는 「여권법」을 준용한다.
