공직선거법 제218조의29(천재지변 등의 발생 시 재외선거사무의 처리)

① 중앙선거관리위원회는 천재지변 또는 전쟁ㆍ폭동, 그 밖에 부득이한 사유로 해당 공관 관할구역에서 재외선거를 실시할 수 없다고 인정하는 때에는 해당 공관에 재외선거관리위원회를 설치하지 아니하거나 설치ㆍ운영 중인 재외선거관리위원회 및 재외투표관리관의 재외선거사무를 중지할 것을 결정할 수 있다.

② 제1항에 따른 재외선거사무 중지결정에 따라 재외투표기간 중에 투표를 마치지 못한 경우에도 재외투표기간이 지난 후에는 다시 투표를 실시하지 아니한다. 이 경우 재외투표관리관은 이미 실시된 재외투표를 제218조의21제2항에 따라 국내로 회송하여야 한다.

③ 중앙선거관리위원회는 제1항에 따른 결정 후 재외투표기간 전에 사정 변경으로 재외선거를 실시할 수 있다고 인정하는 때에는 지체 없이 재외선거관리위원회를 설치하거나 재외선거사무가 중지된 해당 재외선거관리위원회 및 재외투표관리관으로 하여금 재외선거사무를 재개하도록 하여야 하고, 이 경우 처리기한이 경과된 재외선거사무는 이 법에 따라 처리한 것으로 본다. 다만, 재외선거관리위원회는 제218조의17에 따른 기한이 경과된 경우라도 지체 없이 재외투표소의 명칭ㆍ소재지와 운영기간 등을 공고하여야 한다.
