공직선거법 제218조의5(재외선거인 등록신청)

① 주민등록이 되어 있지 아니하고 재외선거인명부에 올라 있지 아니한 사람으로서 외국에서 투표하려는 선거권자는 대통령선거와 임기만료에 따른 비례대표국회의원선거를 실시하는 때마다 해당 선거의 선거일 전 60일까지(이하 이 장에서 "재외선거인 등록신청기한"이라 한다) 다음 각 호의 어느 하나에 해당하는 방법으로 중앙선거관리위원회에 재외선거인 등록신청을 하여야 한다. <개정 2012.10.2, 2015.8.13, 2015.12.24>

② 재외선거인 등록신청(제3항에 따른 변경등록신청을 포함한다. 이하 이 장에서 같다)을 하려는 사람은 그 신청서에 다음 각 호의 사항을 적어야 한다. <개정 2011.9.30, 2012.10.2, 2015.8.13, 2015.12.24>

③ 재외선거인명부에 올라 있는 선거인은 그 기재사항의 변경이 있는 경우에는 제1항 각 호의 어느 하나에 해당하는 방법으로 해당 선거의 선거일 전 60일까지 재외선거인 변경등록신청을 하여야 한다. <신설 2015.12.24>

④ 재외투표관리관은 매년 1월 31일까지 비자ㆍ영주권증명서ㆍ장기체류증 또는 거류국의 외국인등록증 등 재외선거인의 국적확인에 필요한 서류의 종류를 공고하여야 한다. 이 경우 둘 이상의 공관을 둔 국가에서는 대사관의 재외투표관리관이 일괄하여 공고한다. <신설 2011.9.30, 2015.8.13, 2015.12.24>

⑤ 재외선거인 등록신청에 관하여는 제218조의4제3항부터 제5항까지의 규정을 준용한다. 이 경우 "국외부재자 신고"는 "재외선거인 등록신청"으로, "재외투표관리관 또는 구ㆍ시ㆍ군의 장"은 "재외투표관리관"으로, "국외부재자신고서"는 "재외선거인 등록신청서 또는 변경등록신청서"로, "국외부재자 신고기간 만료일"은 "재외선거인 등록신청기한"으로, "여권번호"는 "여권번호 및 「가족관계의 등록 등에 관한 법률」 제15조제1항제1호에 따른 가족관계증명서에 기재된 부 또는 모의 성명"으로 본다. <신설 2012.10.2, 2015.12.24>
