공직선거법 제218조의4(국외부재자 신고)

① 주민등록이 되어 있는 사람으로서 다음 각 호의 어느 하나에 해당하여 외국에서 투표하려는 선거권자(지역구국회의원선거에서는 「주민등록법」 제6조제1항제3호에 해당하는 사람과 같은 법 제19조제4항에 따라 재외국민으로 등록ㆍ관리되는 사람은 제외한다)는 대통령선거와 임기만료에 따른 국회의원선거를 실시하는 때마다 선거일 전 150일부터 선거일 전 60일까지(이하 이 장에서 "국외부재자 신고기간"이라 한다) 서면ㆍ전자우편 또는 중앙선거관리위원회 홈페이지를 통하여 관할 구ㆍ시ㆍ군의 장에게 국외부재자 신고를 하여야 한다. 이 경우 외국에 머물거나 거주하는 사람은 공관을 경유하여 신고하여야 한다. <개정 2011.11.7, 2012.10.2, 2014.1.17, 2015.8.13>

② 제1항에 따라 국외부재자 신고를 하려는 사람은 그 신고서에 다음 각 호의 사항을 적어야 한다. <개정 2014.2.13, 2015.8.13, 2015.12.24>

③ 제1항에 따른 전자우편을 이용하여 국외부재자 신고를 하려는 때에는 재외투표관리관 또는 구ㆍ시ㆍ군의 장이 공고하는 전자우편 주소로 국외부재자신고서를 전송하는 방법으로 하여야 한다. 이 경우 본인 명의의 전자우편 주소로 자신의 국외부재자 신고에 한하여 할 수 있다. <신설 2012.10.2>

④ 재외투표관리관 또는 구ㆍ시ㆍ군의 장은 전자우편을 이용한 국외부재자 신고를 접수하기 위하여 전자우편 계정을 별도로 개설하는 등 필요한 조치를 하여야 한다. <신설 2012.10.2>

⑤ 재외투표관리관 또는 구ㆍ시ㆍ군의 장은 국외부재자신고서에 제2항 각 호에 따른 기재사항 중 여권번호의 누락이 있는 때에는 해당 선거권자에게 국외부재자 신고기간 만료일까지 보완할 것을 통보하여야 하며, 이를 통보받은 선거권자가 국외부재자 신고기간 만료일까지 보완하지 아니한 때에는 그 신고를 접수하지 아니한다. <신설 2015.12.24>
