공직선거법 제28조(임기중 지방의회의 의원정수의 조정 등)

1. 지방자치단체의 구역변경으로 선거구에 해당하는 구역의 전부가 다른 지방자치단체에 편입된 때에는 그 편입된 선거구에서 선출된 지방의회의원은 종전의 지방의회의원의 자격을 상실하고 새로운 지방의회의원의 자격을, 선거구에 해당하는 구역의 일부가 다른 지방자치단체에 편입된 때에는 그 편입된 구역이 속하게 된 선거구에서 선출된 지방의회의원은 그 구역이 변경된 날부터 14일 이내에 자신이 속할 지방의회를 선택하여 당해 지방의회에 서면으로 신고하여야 하며 그 선택한 지방의회가 종전의 지방의회가 아닌 때에는 종전의 지방의회의원의 자격을 상실하고 새로운 지방의회의원의 자격을 취득하되, 그 임기는 종전의 지방의회의원의 잔임기간으로 하며, 그 재임기간에는 제22조(市ㆍ道議會의 議員定數) 또는 제23조(自治區ㆍ市ㆍ郡議會의 議員定數)의 규정에 불구하고 그 재직의원수를 각각 의원정수로 한다. 이 경우 새로운 지방의회의원의 자격을 취득한 지방의회의원의 주민등록이 종전의 지방자치단체의 관할구역안에 되어 있는 때에는 그 구역이 변경된 날부터 14일 이내에 새로운 지방자치단체의 관할구역으로 주민등록을 이전하여야 하며, 그 구역이 변경된 날부터 14일 이내에 자신이 속할 지방의회를 신고하지 아니한 때에는 그 구역이 변경된 날부터 14일이 되는 날 현재 당해 지방의회의원의 주민등록지를 관할하는 지방자치단체의 지방의회에 신고한 것으로 본다.

2. 2 이상의 지방자치단체가 합하여 새로운 지방자치단체가 설치된 때에는 종전의 지방의회의원은 같은 종류의 새로운 지방자치단체의 지방의회의원으로 되어 잔임기간 재임하며, 그 잔임기간에는 제22조 또는 제23조의 규정에 불구하고 그 재직의원수를 각각 의원정수로 한다.

3. 하나의 지방자치단체가 분할되어 2이상의 지방자치단체가 설치된 때에는 종전의 지방의회의원은 후보자등록당시의 선거구를 관할하게 되는 지방자치단체의 지방의회의원으로 되어 잔임기간 재임하며, 그 잔임기간에는 제22조 또는 제23조의 규정에 불구하고 그 재직의원수를 각각 의원정수로 한다. 이 경우 비례대표시ㆍ도의원은 당해 시ㆍ도가 분할ㆍ설치된 날부터 14일이내에 자신이 속할 시ㆍ도의회를 선택하여 당해 시ㆍ도의회에 서면으로 신고하여야 하고, 비례대표자치구ㆍ시ㆍ군의원은 당해 자치구ㆍ시ㆍ군이 분할ㆍ설치된 날부터 14일 이내에 자신이 속할 자치구ㆍ시ㆍ군의회를 선택하여 당해 자치구ㆍ시ㆍ군의회에 서면으로 신고하여야 한다. 다만, 재직의원수가 제22조 또는 제23조의 규정에 의한 새로운 의원정수의 3분의 2에 미달하는 때에는 의원정수에 미달하는 수만큼의 증원선거를 실시한다.

4. 시가 광역시로 된 때에는 종전의 시의회의원과 당해 지역에서 선출된 도의회의원은 종전의 지방의회의원의 자격을 각각 상실하고 광역시의회의원의 자격을 취득하되, 그 임기는 종전의 도의회의원의 잔임기간으로 하며, 그 잔임기간에는 제22조의 규정에 불구하고 그 재직의원수를 의원정수로 한다.

4. 5. 읍 또는 면이 시로 된 때에는 시의회를 새로 구성하되, 최초로 선거하는 의원의 수는 당해 시ㆍ도의 자치구ㆍ시ㆍ군의원선거구획정위원회가 새로 정한 의원정수로부터 당해 지역에서 이미 선출된 군의회의원정수를 뺀 수로 하고, 종전의 당해 지역에서 선출된 군의회의원은 시의회의원이 된다. 이 경우 새로 선출된 의원정수를 합한 수를 제23조의 규정에 따른 시ㆍ도별 자치구ㆍ시ㆍ군의회의원의 총정수로 한다.

5. 6. 제4호의 경우 자치구가 아닌 구가 자치구로 된 때에는 자치구의회를 새로 구성하며, 그 의원정수는 당해 시ㆍ도의 자치구ㆍ시ㆍ군의원선거구획정위원회가 새로 정한다. 이 경우 새로 정한 의원 정수를 합한 수를 제23조의 규정에 따른 시ㆍ도별자치구ㆍ시ㆍ군의회의원의 총정수로 한다.
