국민건강보험법 시행령 제74조의2(손실 상당액 산정기준 등)

① 법 제101조제3항에 따라 공단이 「약사법」에 따른 의약품의 제조업자ㆍ위탁제조판매업자ㆍ수입자ㆍ판매업자 및 「의료기기법」에 따른 의료기기 제조업자ㆍ수입업자ㆍ수리업자ㆍ판매업자ㆍ임대업자(이하 "제조업자등"이라 한다)에 대하여 징수하는 손실에 상당하는 금액(이하 이 조에서 "손실 상당액"이라 한다)은 같은 조 제1항제1호부터 제3호까지의 위반행위로 보험자ㆍ가입자 및 피부양자가 부당하게 부담하게 된 요양급여비용 전액으로 한다.

② 공단은 제조업자등이 동일한 약제ㆍ치료재료에 대하여 법 제101조제1항제1호부터 제3호까지의 위반행위 중 둘 이상의 위반행위를 한 경우에는 각 위반행위에 따른 손실 상당액 중 가장 큰 금액을 손실 상당액으로 징수한다.

(2) Where웨어 manufacturers,매뉴^f팩처^r러즈 etc.엣세터^r러 have해^v브 committed커미티드 two투 or오 more모 of어^v브 the^ð더 violations^v바이얼레이션즈 under언더 Article아터클 101 (1) 1 through^θ쓰^r루 3 of어^v브 the^ð디 Act액트 with위^ð드 respect^r리스펙트 to투 the^ð더 same세임 medicine메더슨 or오 treatment트^r릿먼트 material,머티^r리얼 the^ð더 Service서^v비스 shall섈 collect컬렉트 as애즈 the^ð디 amount어마운트 equivalent이퀴^v벌런트 to투 losses로시즈 the^ð더 largest라지스트 of어^v브 the^ð디 amounts어마운츠 equivalent이퀴^v벌런트 to투 losses로시즈 for^f포 the^ð더 respective^r리스펙티^v브 violations.^v바이얼레이션즈

③ 공단은 법 제101조제3항에 따라 손실 상당액을 징수하려는 경우에는 다음 각 호의 사항을 포함한 문서로 약제ㆍ치료재료의 제조업자등에게 알려야 한다.
