국민기초생활 보장법 시행령 제11조(생계급여의 조건 제시방법 및 결과 통지)

① 시장ㆍ군수ㆍ구청장은 법 제9조제5항에 따라 수급자가 조건부수급자로 결정된 날부터 1개월 이내에 법 제28조의 자활지원계획(이하 "가구별 자활지원계획"이라 한다)에 따라 자활사업에 참가할 것을 생계급여의 조건으로 해당 조건부수급자에게 제시하여야 한다. <개정 2015.4.20>

② 제1항에도 불구하고 시장ㆍ군수ㆍ구청장은 조건부수급자의 근로능력, 자활욕구 및 가구 여건 등이 취업에 적합한 경우 그 조건부수급자(이하 "취업대상자"라 한다)의 취업을 촉진하기 위하여 해당 특별자치시ㆍ특별자치도ㆍ시ㆍ군ㆍ구(자치구를 말한다. 이하 같다)를 관할하는 직업안정기관의 장이 지정하는 자활사업에 참가할 것을 생계급여의 조건으로 취업대상자에게 제시하여야 한다. 이 경우 시장ㆍ군수ㆍ구청장은 자활사업 참가에 관한 사실을 직업안정기관의 장에게 지체 없이 서면(전자문서를 포함한다)으로 통지하여야 한다. <개정 2015.4.20>

③ 직업안정기관의 장은 제2항 후단에 따른 통지를 받은 경우에는 제13조제1항의 개인별 취업지원계획에 따라 취업대상자가 참가할 자활사업을 지정하고 이를 취업대상자 및 시장ㆍ군수ㆍ구청장에게 지체 없이 서면(전자문서를 포함한다)으로 통지하여야 한다. <개정 2015.4.20>

④ 직업안정기관의 장은 제3항에 따른 취업대상자의 조건 이행 여부에 대한 의견 등을 포함한 자활사업 참가 결과를 3개월마다 시장ㆍ군수ㆍ구청장에게 서면(전자문서를 포함한다)으로 통지하여야 한다. 다만, 취업대상자가 조건 이행을 중도에 포기하거나 거부하는 등의 사유가 있는 경우에는 그 결과를 지체 없이 서면(전자문서를 포함한다)으로 통지하여야 한다. <개정 2015.4.20>

⑤ 제2항에 따른 조건부수급자의 구분기준, 조건부수급자별로 제시할 자활사업의 종류와 내용 및 생계급여의 조건 제시방법 등에 관하여 필요한 사항은 보건복지부장관이 관계 중앙행정기관의 장과 협의하여 정한다.
